Should death penalty be abolished?

UN human rights committee holds a historic vote today on a global moratorium over a possible ban on death penalty.
Yes # Capital punishment is a cruel man made law that does not necessarily deter crime but even runs the risk of executing the innocent.
# Right to life is fundamental and the death penalty is a gravest abuse of human rights.
No # If capital punishment is taken away, we will not have an effective justice system and crimes against society will continue to increase.
# Capital punishment can not be equated with murder or otherwise it would require equating arrest with kidnapping and taxation with theft.

No it should not be abolished. there’s no way those criminals should escape who kill others not because they are insane but because killing gives them the kick that otherwise remains passive in those brains of what we call KILLERS.
We don’t kill people by capital punishment but murderers to show people that killing others is wrong.
@ Bhagaban
your point of view is undoubtedly right as death penalty kills the criminal instantly that’s not what a murderer deserves. he deserves a harsher punishment but then the killer will be living in the cells that are comfortable enough for someone who escaped death...thanks to human rights activists who can’t see the killers, murderers, rapists and robbers in a miserable condition.
here while discussing the subject on death penalty i came across the infamous incident that took place there in your country in New Delhi. A man killed his wife, chopped her to pieces and burned her in a fire place.
so i ask what do you think should the husband deserve? Death penalty or lifetime imprisonment in some jail of India where it is very easy to get access of all the stuff like drugs and cellphones. ( i hope i am right with my facts)
this though is not the case with India only, this happens around the globe but the case remains..should death penalty be abolished?
Moral justification of the death penalty can be justified by one simple principle: punishment should be apportioned in severity to the nature of the crime.
this is the reason why i support the death penalty because it is meant for those who didn’t care for others human rights and i believe such a person don’t deserve any sympathy we shouldn’t be gettin emotional while getting rid of such infamy.

I personally feel the capital punishment should be abolished. It is not a harder punishment than life imprisonment in a strict sense; the former kills the criminal at once.

First and foremost duty of any state is to protect its populace from the brutes even if that protection comes from death, the duty remains…any law that doesn’t apply to all citizens should apply to none. And if the person in action is a rapist or a paedophile then death penalty is the only option, I have NO sympathy for those who destroy the lives of others for pleasure.

I don’t view death penalty as a deterrent. If it were; people would not continue killing people. I view it as ending a problem with an individual so that it won’t repeat itself. There’s no argument in the support of the line where we say that we have stopped many from killing because we have something called the death penalty. In the final analysis it does not work fairly. there’s no such as being fair about killing people.
i am against abortions too, in fact i am against taking another’s life in any form. we are thinking too much to execute criminals while ignoring effective punishment strategies.
Death penalty is against the very basis of humanity - HOPE. No punishment should extinguish the opportunity for hope or redemption.

Yes, death penalty should be abolished from all across the world. It is a barbaric practice reminiscent of medieval mindset and savagery. Let’s see why there is provision for death penalty in certain countries and what has death penalty achieved so far?
a) Did it act as a deterrent to potential criminals from committing crimes for which she/he can be punished with death?
b) Did it bring down crime rates that might invite death penalty in those countries?
The answer to the above two critical questions above is a big NO.
China, where large numbers of people are executed for white-collared crimes such as corruption, still remains one of the most corrupt countries in the world. In fact, corruption in China has gone up and is still going up. Similarly, is the case of drug smuggling, rape and murder, and this is despite 1000s of executions for various crimes there. In the US, where a large number of people are executed each year for murder has now more murders than ever before. The US has the largest number of criminal prisoners in the world.
When India carried out a rare execution of Shri Dhananjoy Chatterjee for the rape and murder of a school girl a few years back, did it bring down the cases of rape and murders in India. In fact, it is proved that death penalty has not been able to deter people from doing the crime.
On the contrary, when Europe abolished the death penalty, crime has fallen. A quick, fair justice system, a clean crime detection and prosecution system like independent police, respect for human rights and positive things in society ensures lower crime rates, not barbaric practices like death penalties.
Putting a man to death shows lack of civility. This shows that the society is incapable of rehabilitating or reforming a criminal. If it is proved beyond doubt that someone cannot be reformed, then put him behind bars for life. That way the person would be able to think what he is missing out and think, and maybe seek redemption.
Death penalty also shows intolerance and thus by executing someone, we stoop ourselves to the level of the criminal we are putting to death. It shows lack of spine, feelings and evolution to civilized society.

I do agree that death penalty don’t work as a deterrent but should the criminals convicted of murders be be treated better than their victims? but to argue the point that there’s no difference between them and us...we should not miss the point Justice. justice or punishment (in this case) is apportioned after looking at the severity of the nature of the crime. ( very well said Ananickole)
If another Hitler came along tomorrow and tried to wipe out a complete race what would we do to him if caught?
Also i would like to repeat Ananickole’s question - what do you think should the husband deserve? i guess she is talking about the infamous Tandoor kand.
A cold blooded murderer deserves to die - a suggestion that is in keeping with the concept of dharma as expressed in the Bhagavad Gita. The death penalty is the culmination of a functioning legal system.

It is a good idea to release all the psychopaths and the perverts. Why keep them in the jail. There the poor souls are tortured...
Frankly, we are too much bothered about being human with animals. Does anyone care for the victims.
Oh, we all know the ’turn the other cheek’ routine and Dead Man Walking songs, but that’s to discount the fact that Jesus showed anger in the Temple. We must hate the sin and not the sinner but what is to be done if the sin and sinner become one?
Evil walks this earth, demons roam. We need to stake vampires.
Vampires are not superhuman, they are people turned subhuman. The Maninder Singh Pandhers and Kohlis of this world.

We need to distinguish between stoning honest men and not murdering, but getting rid of pests.
How can one pardon a guy who rapes and then kills a two year old baby girl?
How can one let live a person who meaninglessly shoots at kids?
What we think of as civilized treatment of criminals, these people think as our weakness.
May be reading this, some bad element is thinking ” wow, my time has come; I can do whatever I want”
Nobody wants medieval brutalities to be back, because we are civilized we know where to stop. Otherwise other Jessica Lalls will die..
Because pedophiles and vandals do not know the limit they are primitive and brutes. So they will understand only brute force.
Do not forget animals roam amongst us...
I cannot even call such criminals as humans. They have chosen to become like packs of hyenas.

Let’s not talk about irrelevant religious scripts on certain issues w.r.t. the times now.
The Koran prescribes stoning to death, chopping of limbs etc., The Bhagavada also justifies killing of human beings under certain circumstances. Similarly, the Bible too advocates for the death penalty in certain cases. When those scriptures came into being, corporal punishment including death was used to instill fear in the minds of people for going against the state (which was always governed by religio-politico rulers). For them, they needed to justify certain actions, and used religion and God for the purpose.
What is the situation now? When we see an adulteress being stoned to death, a person caned and whipped before execution, chopping of limbs for burglary, teenagers hanged in public for being gay, we cry SAVAGERY! The countries or societies who do such things have their own laws and justifications. In India, we put a thief to jail, adultery is not a crime (it can only get u a divorce against your spouse), and gays are not even prosecuted (though the Section 377 of the Indian Penal Code of 1860 has provisions of life imprisonment for violators. The law was formulated during the British Rule and now is considered redundant).
Now, how many of my friends on the right column would like such things to be commonplace across the world especially in the very societies they live in? I am sure that only a handful. So how can you justify death as punishment on one hand and be against it on he other.
For some societies, small crimes according to us are bigger for them, so much so, that death penalty is required.
The world has different standards in different societies. In places like EU countries, you don’t get death for even the most hideous of crimes. Some countries like Portugal has provisions for parole after 25 years behind bars even for murderers. And, where these lenient societies exist, crime rates are the lowest. Therefore, how do you set a benchmark for a criminal to be put to death legally?
Death penalty is not justice, it can never be a punishment. It is rather the end of justice and a complete non-punishment. Punishment by nature is to make a doer of a crime feel for what he had done, seek subsequent redemption no matter how long it takes.
The civilized society should encourage this and not put a full stop.
Were Mr. Dhananjoy Chatterjee who swung from the gallows of Alipur jail, or Mr. Stan Tookie Williams who got the lethal needle the same men who committed the crimes when they were executed? The answer is an emphatic NO! It merely killed the functioning and healthy bodies of two people.
Death penalty is the ultimate irony and murder, anyway you see it and the civilized societies say - you just can’t murder.

yes, it should be abolished, how would you feel if your son were accused of an horrendous crime that would ultimatley lead to the death penalty and you were convinced that your son was innocent, the death penalty would only hasten his demise, would you like the sentanc e to be life and have the time to convince the powers that be that he was innocent.?

those hard-hearts will never think anything as punishment unless they are hanged.
Psychiatrists who deal with psychopaths have repeatedly pointed out that some killers have no conscience at all. So unless they are physically punished or made to feel the pain of death...they will never understand what they did.
Other psychopaths who may be reading are by now in ecstasy. Hoorah! we have advocates now...

You need not be on the receiving end of violence to debate over whether death penalty is required or not.
Allow me to give you some examples.
a) Gladys Stains, whose two small boys and husband were burnt alive in the most hideous of fashions by a mob led by history sheeter Dara Singh, pleaded the court that his life should be spared.
b) Sonia Gandhi requested the judiciary to spare the lives of those convicted for the assassination of her husband and former Prime Minister of India, Rajeev Gandhi.
c) Sabrina Lall, the sister of the slain model Jessica Lall speaking on behalf of her family said that the family members of the murdered Jessica do not want the guilty Manu Sharma to be given the death penalty.
There are many, many more such incidences where close kins of murdered people didn’t want death sentence for people who killed them.
The society needs compassion and not bloody retribution in order to wipe out or reduce violence and other crimes.
Your comment ’Do not forget animals roam amongst us...
I cannot even call such criminals as humans. They have chosen to become like packs of hyenas.’ smacks of complete lack of sensitivity towards life, be in your support for death penalty and using hyenas as an analogy for criminals deserving death.
My friend, hyenas as not criminals. They hunt in the way they do for survival, just like you have to eat to live. For you, lynching a man suspected of a crime and beating to death a leopard that strayed inside urban localities is the same. This is reminiscent of mob mentality.
The society becomes and even more dangerous place when people with this type of mentality exist.

I would like it to a person to be LYNCHED instead .

My point precisely that hyenas hunt for necessity. There are people amongst us who kill for joy and necessity. It is because of people like you that serial-killers have a field day.
And all those names you dropped, most probably they were compelled by fashion-chasing media men to say and demand all those pardons.
this talk of civilized adoration of hardened heartless criminals smacks of a type of lilly-liveredness which has done us in.
Now for some stats: serial killing and rapes are on the rise...why? Notice as death penalties have become increasingly rare, killers have more freedom and no checks to murder...when good men do nothing then the impure have all the passionate intensity.
Wake up my friends on the left, it is nice to theorize and debate and hide behind words and fear being thought of as unfashionably truthful. It is nice to call opponents shameful names. But will anyone have the guts to call Hannibal Lecter anything on his face?

Consider the costs of abolishing death penalties.
1. Criminals and Killers will know that the max punishment is a life term (14 - 25 years which will be reduced if they display good conduct in jail and/ or if they have right political connections).
2. Why should taxpayers pay for the housing, food and entertainment of these killers while they are in Jail?
Before I talk of advantages of retaining death penalty, I would like to emphasise that our criminal investigation system and judiciary should be perfect and not let any criminal escape and prevent any innocent from being punished.
Death penalty should not be easy and simple death like hanging, electric chair or gas chamber. It should be cruel and scary. It should be meted out in full view of public like in a barbaric society. This will put fear in prospective killers hearts.
About Gladys Staines and Sonia Gandhi and others who gracefully pardoned their husbands’ killers. I believe that it was a mere publicity gimmick, the former to gain more converts in Orissa and the latter to gain votes and become PM. You might say at that point in time she didn’t want to get into politics... but then ultimately she has come into politics and almost become a PM. And even now given 1/10 chance she will become the PM and help Mrs. Staines achieve her goal.

We live in a democratic society and everybody has the right to live....and possibly do himself and the society some good. People change and this has been reflected in the past. People have come out of imprisonment to become great reformists. The best example I recollect- Nelson Mandela.
If the death penalty was the ultimate and the best penalty for a crime, why were some kings in history termed as tyrants? The reason was simple- they resort to the ultimate punishment soon enough to be branded as a tyrant. One this is for sure- When we die and about 4-5 generations pass on can the death penalty be seen as tyranny? Well, at the pace of things, it might possibly be a newer definition of tyranny.
The life imprisonment is a life wrecker in itself. A person should always be allowed to change himself/herself.
As Jonty said, Right to live is for every living thing on this planet. Who are we to decide who shall live and who shall not?
Maybe the life imprisonment term of 14 years should be made longer (like in US) and depending on the person’s behavior, the prisoner is released earlier.

Well, I myself think the death penalty isn’t used enough by all means, in the cases of murder! Why should taxpayers have to support a prisoner who has committed the worst crime in the world? Murder! I strongly and truly believe that anyone who murders another human being should be put to death without delay!!! When found guilty of such a horrible crime!
And no age limits either! We have Kids killing parents and kills now!
I also feel that Child Molesters ought to be put under the crime punishment of the death penalty! Now the laws mention that imprison them for life, well now there is one more taxpayers debt! Prisons and jails are all the time packed, why not empty them out of Molesters and Murders and give them all the death penalty! Which they truly ought to have as there is a danger to the public and they ought not to have to live the rest of their lives in detention center and jails and be fed daily until they die of old age! That money to support them losers could be utilized for a better service for all the Drunks and Drug addicts!
The laws are getting so weak on such cases as murder now! Lawyers are getting killers off death row and life sentences now! Hell! There are scores of people who just serve 7- 10 years in jail for putting people to death now! Is that all a human beings life’s worth now? Come on were spending billions of dollars killing the 9-11 terrorist! By abolishing the capital punishment would just cause to more and more murders!!!
Life in jail nowadays is an easy street for killers, why anybody believes that’s better than only finishing off them! has to be completely insane! They snatched an innocent life, and their life also must be snatched for committing such an act to somebody! Yes you can quip, two wrongs don’t make it right! Well then, why US was at war with Iraq and Afghanistan? There was enough slaughtering going on everyday. We have to prove the wild people that if they murder somebody, they would also meet the same fate! Don’t allow them to pass the rest of their lives in jail!
I want a law to be passed, where if somebody takes life of somebody, the kindred of the victim who was killed should be given chance to kill the killers by law! The laws is going softer and softer each year with murders and drunks and drastic changes are required to be brought about to allow the human race make out murders and molesters no longer get a free pass to a life in jail!
You take a Life, you lose your Life! Imprisoning them doesn’t mean taking their Life away! They brought someone to a halt from getting old, so they need not have that right to get olds either! Plain and simple!!!
All the child molesters ought to be severely punished with rapists! For all MURDERS! No if’s and But’s about it!
Various countries believe that under no circumstances should the capital punishment be awarded. This view is shared by lots of people who argue that God alone can take away life. It is all just fine to have a discussion in an idealistic and philosophical tone. But one must listen to the pain of the near and dear of the victims to know their agony — mainly in the instances where the victims of murder for gain and gang rape are minors. The fear of death can only have a deterrent effect on criminals who have scant respect for human lives. Death penalty must not be abolished. The state must make use of it only in extreme cases.
And no age limits either! We have Kids killing parents and kills now!

@ Sailbose,
Nelson Mandela didn’t go to Jail as a murder convict. He went to jail as a revolutionary and freedom fighter. Same as Mahatma Gandhi or Jawaharlal Nehru or Bhagath Singh or any other Indian freedom fighter.
Please don’t demean these great souls by comparing them with a cheap murderer.

I am agreed with that death penalty should be abolished .Criminal should be dealt with life imprisonment or other penalties. To give death sentence is sama as murder offence . The family of the convict suffer more than the convict himself . Are the little children, old parents or innocent life partner doing offence?Answer is ”no”. Convict should be made to realise his fault and bring back to normal life .

To abolish death penalty! What for? Yea surely do that and give the free license to offenders to go amuck. A criminal who has done heinous crimes against humanity should have no right to live – as far as I think. Otherwise, the freaks like Saddam, Ayman Al-Zawahiri and above all Bin laden should certainly be conferred with the ‘Nobel Prize’ for peace.
Furthermore, I really am not able to understand why death penalty not works as a deterrent. China is the biggest example. If the death penalty will be abolished there, then what will happen is not difficult to imagine. Even if we take it as a fifty-fifty equation, then in the condition of abolition, it will become 100 %. Means do whatever you feel and no fear of life! And… I need not to explain more, for I think every one knows, what I mean by 100% freedom.

At that point of time, these revolutionaries and freedom fighters were also branded as criminals by the people who imprisoned them. Thats what branded the people who imprisoned them as tyrants. Our present system may deem some people (not all) as criminals, but at a later stage the thought stream MAY change and people MAY know these people as revolutionaries or a great person with some great ideology.
History has examples of people changing with time..Ashoka, Rishi Valmiki being a couple of the many instances.
People change with time....so, why not give it to them. The capital punishment is not a remedy. Its the crime which should be removed...not the criminal.
There is a famous saying- Nobody is a born criminal. so, whats the hassle in giving people another chance?

The hidden question lies here whether capital punishment will deter crimes committed all over the world. The answer is invariably no.
I personally feel the capital punishment should be abolished. It is not a harder punishment than life imprisonment in a strict sense; the former kills the criminal at once.
Life imprisonment means isolation, deprivation from freedom of speech and expression.
Deprivation of the society is the hardest punishment than anything else.

Death penalty is the ultimate irony and murder, anyway you see it and the civilized societies say - you just can’t murder.

those hard-hearts will never think anything as punishment unless they are hanged.

No, I do not agree with death penalty.Ofcourse it does not act like a deterrant.
I would like it to a person to be LYNCHED instead .
It should be more painful than the peaceful hanging by the noose.

My friend, hyenas as not criminals. They hunt in the way they do for survival, just like you have to eat to live. For you, lynching a man suspected of a crime and beating to death a leopard that strayed inside urban localities is the same. This is reminiscent of mob mentality.
The society becomes and even more dangerous place when people with this type of mentality exist.

They have chosen to become like packs of hyenas.

well my friends on the left:
You speak thus for you have never been in the face of violence. If you were at the receiving end, I am sure all this humanity will fly away.
Debate and sing the praise of evil people, make spacious arguments, those pedophiles and rapists and murderers are having a field day. they are laughing through their noses...

those hard-hearts will never think anything as punishment unless they are hanged.

@ Sailbose,
Nelson Mandela didn’t go to Jail as a murder convict. He went to jail as a revolutionary and freedom fighter. Same as Mahatma Gandhi or Jawaharlal Nehru or Bhagath Singh or any other Indian freedom fighter.
Please don’t demean these great souls by comparing them with a cheap murderer.
